I'd like to know if there is an existing class action lawsuit, or if
there is one "in the works" against AT&T Wireless regarding the
following situation which appears to constitute an unfair and deceptive
practice on their part.
The AT&T Wireless website, www.cingular.com
or http://tinyurl.com/yr3l8r
advertises the following:
FREE RAZR
See if you qualify for a free upgrade.
After $50 mail-in rebate debit card.
After logging in, and going through the screens to select your "FREE"
phone, you'll be notified of an $18 Upgrade Fee.
The only way to get the "FREE" phone is by agreeing to pay the "Upgrade
Fee".
What does the "Upgrade Fee" provide for the customer? Nothing, except
for allowing the customer to get the "FREE" phone.
What does the "Upgrade Fee" provide for AT&T? Customer has now signed
a new 2 year contract, which if he breaks within that 2 years, he has
agreed to pay AT&T around $170. PLUS, the customer just paid AT&T
$18.00 for this. Had the customer not wanted the new phone, he
could've kept his AT&T service for as long as he wanted without having
to pay the approximately $170 to end his service.
I spoke with AT&T Customer Service several times asking them to waive
the $18 fee since the phone was advertised as free. I was told that
the $18 fee had nothing to do with the "FREE" phone. I asked what good
I got from the $18 then, and they'd say "you signed a new 2 year
contract". I'd say "I don't want the 2 year contract, just the free
phone." They'd say "you can't get the phone without the contract".
I'd say, then the phone isn't free 'cause the contract provides
absolutely nothing for me the customer. Then they'd just repeatedly
say, "you could've picked a phone that wasn't free and not had to sign
the new contract".
I asked to speak with a supervisor but was put on hold for a long time
until I finally hung up.
Anybody else think this stinks?

There wrong. Unless your paying full retail for the phone, any phone will
put you into a new 2 year contract.
But paying full retail for a iPhone still put's you into a 2yr contract.
Even if you were given one. (iPhone)

Unless you Jailbreak and simunlock which takes like 10 mins now, then you
can just pop your AT&T sim (or other if thats so). And you have no extended
contract. Just make sure you have a data plan.
