I need some help.
I have been jerked around since September regarding a $50 rebate + $50
trade in. Here is my story.
I bought 4 Motorola phones in July 2003.
I sent 4 rebates (along with proofs of purchaces MEI tags, reciepts
and trade in phones) in 4 seperate envelopes.
During a 3 week span in September 2003, I received 4 letters telling
me that due to my geographic location, I am not elligable for the
rebate. Along with the letter came everything I had sent except the
trade-in phones.
I called the number on the letter and I was told to resend everything
- it was a mistake on the rebate company's part. I pointed out that
they did not return the trade-in phones and I was told it was their
policy not to return them. I was told "don't worry"
In Oct, 2003 I received two $50 checks (for the rebate on two phones)
I called up to find out where the remaining $300 was (trade-in on 4
phones and rebate on the remainin g two phones) I was told they must
be in "process mode"
End of October - still no additional money. I called up and was told
that they had no record of the trade-in's. I said I had proof of
mailing they said too bad. I said that I was told to resubmit
everything when they sent out the bogus geographic letter but they did
not return the phones so I could not resubmit them. They then told me
that there was a problem with one of the two remaining rebates. It
seems as though someone else had my exact phone number and exact same
mei number . I said that was impossible. More likely someone entered
my information under the wrong name / address. I was told that there
was nothing that could be done about it as a check was already issued
to the other person.
I hung up and went to my cingular dealer. Luckily the district
manager was in the store. She called the Young America rebate
company. She told them that based on the weight shown on my postal
reciepts, I had to have mailed something that resembled a phone but if
it would expidite things she woul;d give me 4 phones from her
storeroom to resubmit. The person on the other end said that he would
expidite the MEI proble with the 4th rebate.
I resubmitted everything along with a second set of 4 phones.
End of November - I call up to get a status. I was told I should have
the remaing $300 in two weeks. Three weeks go by. I call back, I was
told that the trade-in checks for three phones have been processed and
will be mailed shortly but there was nothing they can do about the 4th
phone with the "duplicate phonne number and mei number"
To date I have since recived everything for three of the four phones
and I am told I am out of luck for the forth becuae Once it is in the
system.... there is nothing that they casn do about it.
I hgave spoken to managers who have told me that the problem would be
fixed - only to find out that their hands are tied. I have asked to
speak to Vice-presidents and was told that they can not give me the
number.
What should I do?
As fars as I am concerned it is the rebate company screwing me and not
Cingular.

Not at all. Cingular is only too happy not to have to repay the rebate
company for fewer rebates having been issued.
Write to your State's Attorney general simply listing everything you
posted here, and send a Certified copy to Cingular.

Cingular owes you the money, not the rebate company.
Call cingular customer service. Tell them you're having trouble with a
rebate, and have tried your best to resolve it for months.
Now, politely tell them your intention is to sue them in small claims court
in the state of your residence. Ask them for a valid address where the
process server can serve the papers. Ask them for the address of their
regulatory agency, so you can file a complaint.
If your problem isn't resolved, follow through with small claims and
complaints.

i think im getting somewhere with them now...
ok... they told me to wait seven days and if no check from young america... im to call cingular customer care and they will credit my account.
ill keep ya posted...till then.................

I just got fired by Cingular customer service, [temp, handling country-wide
calls after hours] in Georgia - no reason given so far. I was honest when I
talked with customers, had excellent reviews and followed Cingular's arcane
rules to the letter - if anyone from Cingular, GA is monitoring this; think
PomPoms - they manage by intimidation, encourage employees to lie - I have
refused to play "manager" to callers while other employees on my level have
gleefully accepted that role. I was offered a full-time job in writing and
fired 48 hours later having worked my assigned shifts, with no errors or
offences.
No reason given.

On the second page of your cingular bill there will be an address to contact
the president of the company. I'm sure it's not the president but if you
write to that address there will be an inquiry to your delima. This is what

i got the check in the mail the other day (01/30).
threatening to sue DOES get you somewhere... i dont know if it was cingular cust care OR young america, but, the envelope was dated a only a day after the call i made... i guess they think that ppl will just forget that they got a rebate comming to them so they dont have to pay. well... thats not how my world goes round. if im owed $$$ you better believe im going to collect. and why not!? EVERY company the world-over does it. anyways... if they didnt cough up that rebate/credit my account by TODAY... i wouldve had no problem what-so-ever taking them to court. even if it cost me more than that rebate... its the principal of the thing: dont promise something you either wont or are unwilling to readily deliver...
maybe after this contract is up i might drop cingular just for spite,(not that they will care), and try out sprint...

I'm in the same camp as you. I've spent $3k to force collection for
$300 owed, if for no other reason than to teach some ignorant corporate
twit that good people won't stand for getting screwed. The really
ignorant corporate twits try to act surprised when the final bill
includes my attorney fees and other relevant costs. In the end, that
$3K comes out of their pocket, not mine. My motto? Don't **** with me
because I'm the rat-bastard that'll **** you back. Otherwise, I'm a
really nice rat-bastard. I love hungry attorneys, they'll fight for
every bone I toss into their cage. A hungry attorney is mucho bettero
than an insurance policy.

Small claims is a wonderful device for the consumer. When suing a
business, the law requires them to be represented by a real live lawyer,
while you can represent yourself. This means they need to spend money.
If they don't hire a lawyer, or fail to show, you win!
Of course, winning a judgement and actually getting money are two
different things. However, just dealing with the paperwork when served
is often more expensive than just paying out what they owe in the first
place, whether they intend to show up in court or not.
It's a VERY powerful tool. Use it wisely and fairly.
