I recently changed from my 500 minute GSM nation plan $39.99 with an
additional line for $9.99 to a GAIT nation plan for $45 for 400 minutes and
went to one phone on that plan since an additional line for a GAIT plan is
$19.99 instead of the $9.99 I had with the GSM plan. So since I dropped the
$9.99 line Cingular is charging me $60 for liquidated damages charge. Now
the girl on the phone who swapped my plans did tell me there would be a $20
penalty for swapping over which I didn't think was too bad but, she didn't
say it was going to be $20 a month. My contract would have been over in
December so they are charging $20 a month for the rest of my contract. It's
not like I left Cingular and it's not like they are losing $20 a month. If
anything they are only losing $5 a month in revenue since I was paying $50 a
month for the GSM nation and now I'm paying $45 for the GAIT nation and have
fewer mintues to boot. With this kind of treatment and now that my contract
is fulfilled I may very well go to the Sprint Free and Clear plan for $45
and 500 minutes and get unlimited nights and weekends instead of 1,000
nights and weekends with the GAIT plan. As long as I don't go over 500
minutes a month which I seldom even come close to then the Sprint plan looks
very appealing and they have pretty modern phones compared to the Sony T62u
and the Nokia 6340i. This will have been the second time Cingular has stuck
it to me on something like this. I don't think I will allow them a third
    chance.

What Cingular lost was the subsidy recovery on that discounted phone you no
    longer want.

You'll have the same issues at any other cellular company. The "price" of
cheap or even free phones is the minimum term of the service agreement, which
is how the carrier recovers the phone discount.

    John,

I agree. I personally think the two year contracts are far to long
I signed up for one but will never do so again.

I might just pay full frieght for the phone and be done with it.

Cingular should be happy that you remain a customer. It's not like I was
terminating their entire service before the end of the contract and they
were actually only making $5 less a month off of me. If they had offered to
let me have an additional line on the GAIT plan for $9.99 like they had on
the GSM I would have gone ahead and done that right off and they would have
been making an additional $5 off me a month. So what I did yesterday was to
call up a second time. The first time I called yesterday I got a male
representative and he was like that's just tough and that's the way it is.
So when I called back later on yesterday I talked to a nice lady and she
removed the $60 penalty and I instead signed up for the additional line on
the GAIT plan for $20 a month so at least I'll get something for my money
until the end of my contract. If the lady who originally swapped me over to
the GAIT plan had said it was going to be $20 a month I would have been a
fool not to have signed up for the additional line until the end of my
contract but, she told me there was only going to be a $20 penalty. She
didn't say anything about it being monthly. If people want to drop a line I
think they should be able to do so without suffering a large penalty. If
they want to discontinue service completely then yes hit the customer with a
big penalty but, if you are keeping some form of service then don't try to
stick it to the customer because if you leave a bad taste in their mouth
they likely will not renew when their contract is over.
Now on to the phone cost BS. In my personal experience I was screwed
because when I very first signed up with Cingular I got a Motorola T720 I
think that was the model anyway and it was a hunk of sh_t. The earpiece
volume was so low I couldn't hear out of it going down the road in a quiet
vehicle and the headset was even worse. That was the first problem I had
with the phone and the second one was that the darn thing didn't ring half
the time people called me even though I was in a high signal area. So when
I went back within the first 15 days I traded the Motorola for a Sony T616
and I also got a second T616 for my wife to use and swapped over to a family
plan. I had already sent in the $50 or so rebate on the Motorola which was
the same rebate they were giving on the T616's. But, since I returned their
defective Motorola I was denied the rebate even though I had just traded up
to the T616 for my self and a new one for my wife. I was also not given a
rebate this time with the new T616 since it was a exchange type of deal at
Best Buy. I could have probably gotten that straightened out if I had known
who to contact but, I just chalked it up to experience and was relatively
happy with the GSM coverage until recently and I was about to get shafted
again. I'm content with the situation right now and will ride this out
until something better comes along. The Sprint free and clear with the free
and clear America plan is very comparable to what I currently have with the
GAIT but, I'm in no rush to get back into another contract and the plans
cost the same amount so there is no incentive to leave Cingular.

Yep I agree. I signed a two year contract and will never sign

I love Cingular, but I would suggest Verizon before Sprint.

    Dear Victim,
Quit whining. You agreed to a contract, and you broke the contract.
If this were any other customer service issue, you might have a case.

That's what I've always done -- I prefer an unlocked, unbranded phone with
    standard firmware.

In the past you could sign up for month-to-month service from Cingular, but
now the only options are 1- and 2-year contracts. So it may make sense to
take the smaller subsidy discount on a 1-year contract if you don't mind
    locking and branding.

True -- it costs on the order of $350-400 to replace a lost customer.

The issue was the subsidy on the discounted phone you no longer want, not the
    amount per month.

It pays to be persistent and to talk to more than one person, as you've
    discovered.

Again, the issue was the subsidy on the discounted phone you no longer want,
    not the amount per month.
