Yes you do have the current versions of both hardware and software.

If you've already ported before your termination date, you need a leg
to stand on as to why you shouldn't have to pay the EFT. The example
case I believe was someone who was very near the end of his contract
and ported before the expiration date. I never recall receiving an
answer as to whether he had paid the last bill by its due date. If he
did, that's where I think he had an argument that he had fulfilled the
requirements of his contract, and therefore owed no EFT. But to
answer your question, in theory, it should make no difference. My
suggestion was based on legal theory only. I've never seen or heard
it argued as an out for the EFT, probably because the porting issue is
so new. Since it's one of those 'I think it will work, but I won't
know until I try it' kind of things, I just wouldn't put myself in the
position of having to make that argument. The other poster had
already ported, so he had nothing to lose by using that argument. If
he had asked before he ported, I would have advised him to wait.

    >Besides, I think the argument could very well work anyhow. They are NOT
    >losing anything at all if I cancel right now. They will have received

That is my point exactly. And after receiving payment for the
remaining contract period, they can shut your service off and know you
won't be incurring any overage, SMS, or other charges. They will have
received their money up front, and will have one less customer putting
a demand on their system. I'm sure no one at VZW put any thought to
someone buying out the rest of their contract, so they never addressed
it in any contract I saw. I don't know about the new ones, though, as
my two year contract was up just last month. I think I'll play a
round of 'Stump the VZW CSR' next time I go in.

The latest Sanyo lineup seems to be plagued with poor earpiece sound
quality (possible exception of 4920) and other problems such as the
redialing issue. I haven't heard much about overheating. They've
quietly released new batches with new hardware and software on many of
the newer phones (both Samsung and Sanyo) but most people would have
no way of ever knowing about this. It would be nice if Sprint sent
their customers a notice when this happens but at the same time I
understand why they don't. Hardware cannot be updated like
software/firmware can and the only way to get a phone with new
hardware is by swapping them out or buying a new one. Sending out a
notice about software updates could create an overwhelming rush of
customers to the stores as well as other expenses involved.

So theoretically carrier B could get a lot of "free" numbers and
carrier A will have to buy new numbers. An additional cost of losing
    customers.

The expense should be the manufacturer's, not the carrier's, as the
manufacturer is the company who built the defective phone. Sprint's a big
carrier - if they have a batch of defective phones they should be putting
pressure on the manufacturer to replace them.

My Brother was just in Chicago last Fall and reported no issues at all.
In fact, I spoke with him (PCS-PCS) for more than 30 minutes while he
was there and noted no problems with the call.
