I had not thought about the
ESN.
There won't be any rebate involved. That's another issue that leads me to
this path: while I have been a suscriber long enough, for the rebate plans
you need to have a plan of $34.99 or higher. Well, fortunately (for me),
our plan is less than that. That's why I don't want to 'upgrade' and get a
new contract at the current rate. I can't see paying more per month when we
don't use our minutes up anyway now.

I have bought probably 4-5 phones off ebay, most new but a couple used.
Never had a problem activating them with Sprint, just make sure the
ESN is clear and the phone will work in your area. Activating a
different phone from my experience will not alter your contract, but it
will alter your rebate timeframe. So you may want to check and see if
you qualify for a 75.00 or 150.00 rebate first.
