Actually I haven't left any feedback yet. The neutral you saw was
from another seller. I don't leave feedback until the transaction is
complete and I don't consider it complet until I figure out how the
seller is going to remedy the situation.
Of course if i leave a neg, they'll leave one for me in return and
I'll have my first neg with a feedback rating of over 500. That won't
stop me from doing it but it still irks me.

If you paid within the agreed upon timeframe, then they have no right to
leave negative feedback.
You can dispute the feedback with EBay and leave a reply to the negative
feedback.

I still don't think that absolves the seller of any liability, though
IANAL and I could be wrong. If he knew there was a problem with this
phone, and sells it without mentioning that it's blacklisted, you can
make the argument that you took part in the sale under a good faith
assumption that the phone would be activated.
However, yes, the ESN should have been checked, especially if it was
posted... if anything for your protection.
I would still leave negative feedback on him, and try contacting eBay
for a resolution.

If that's the case, then to be blunt, you probably shouldn't be bidding
on so many phones. I would have no sympathy for the person who went
used car shopping, bought a total junkheap under "as is" conditions and
then complains about it but didn't take the car to get looked over by a
trusted mechanic before buying, or at least run a Carfax report on the
VIN because "if [he] did that to every car [he] looked at, [he'd] never
get anything done."

22 negatives, 10 of which were in the past 6 months. And 23 neutrals,
many of which I'd probably classify more as "negative" when you read the
comments but I imagine the buyers posting those comments didn't want to
risk having this guy retaliate with negatives of his own. I definitely
would have been concerned.

I feel your pain but look in from the other side. I had a 4900 stolen
and used a few times before I knew. I called the numbers they called
and other then finding out some sketchy details about the potential
thief, I did not get my phone back. I would like to think that
whoever finds or has this phone would NOT be able to profit from
selling it or use it themselves. It is my phone after all. Not that
your phone had the same story but it is blacklisted for a reason and I
would bet the seller or someone close to the seller knows why.
