    I have a LG-1010 that has a intermittent mic, it's less than 1yr old.
    The Sprint store sale rep said if I signup for Sprint Long Distance, he can
    order me a reconditioned LG-1200 phone.
    I think something is fowl with this business practice. Sprint should have
    repaired and/or replace the defective unit without strings attached.

    Typical bad Customer Service. He's prolly getting spiffed for signing up
    Long Distance, so he lied to you. Ask for Store Manager, don't take the
    BS.

    From what I was told about the defective LG 1010s was this; there *was* a
    recall, but the recall was at the store level, not the consumer level.
    Check with others before you go switching phones and not seeing any
    different results. If others in your area have acceptable service, it may
    indeed be the phone. However, at Sprint's suggestion, I went through six
    phones before I came to the conclusion that Sprint had just overloaded it's
    towers and wasn't going to do jack about the lousy reception, dropped or
    missed calls, etc. Also, one of the *used* LG 1100s they replaced my LG
    1010s with was also defective. The screen wouldn't come on when the phone
    was turned on. They barely replaced that one.

    Also, the last set of phones I purchased, again at their suggestion,
    automatically signed me up for a two year contract.

    Not too mention, their policy is to *never* waive the $150 fee, no matter
    whether you are receiving coverage in an advertised area or not.

    Their TOS says:

    Coverage. Most services are only available within the operating range of
    the Sprint Nationwide PCS Network(also see Roaming). Coverage is not
    available everywhere. Coverage and quality of Services may be affected
    by conditions within or beyond our control, including network problems,
    signal strength, your equipment, and atmospheric, geographic, or
    topographic conditions. We do not guarantee service availability or that
    there will be no interruptions or delays in Services (e.g., dropped
    calls, blocked calls, etc.).


    except that is limited by the Common Law concept of "Fitness for
    Purpose".
    i.e. if you buy a car, and the transmission never works, you are within
    your rights to get a refund. Similarly if you can't use your phone,
    You must be free to get out of contract.

    Lee, there is some missing information. You mentioned it was less than a
    year old. If you don't mind, when did you buy the phone from SPCS? I ask as
    the phone could be over one year old. LG-1010s have been out for quite
    awhile.

    Did you get your phone tested by the store technician? If you did, what did
    he/she say? If they find the phone defective, they would be the ones to
    offer a replacement phone.

    BS. He should be able to order you a replacement phone regardless of
    whether of whether you sign up for LD or not, and I'm sure any other
    Sprint store would've been happy to do it for you. It's not company
    policy to require an LD signup. You should either go back and insist,
    or go to another Sprint store.

    Exactly, and it's not like the dead spot here is just a spot. It's more
    like a county.

    go back and talk to store manager about it,should replace phone under
    warranty,no cost to you.

    You claim these dead spots and lack of signal are caused by
    overloading of the local tower and it is effecting everyone in the
    county. If no one in the county can get a signal because of this then
    who is actually using the tower causing it to be overloaded? Not that
    it would be acceptable but did you have better connections during
    typical off peak hours like really late at night or early on a weekend
    morning? Was this overcrowding condition gradually getting worse or a
    sudden change? Did your signal strength meter appear to be high but
    you just counld not complete calls or was it near the lower end?

    I assume that tower sizes and capacity can vary but what are some
    typical capacities? I live near a very dense area and there is only
    one tower near at this end of my county.

    Yes, they should have ordered another 1010.

    He was offering you a free upgrade, to a more current model, wich
    technicaly they aren't supposed to do since the 1010s are in stock for
    warranty replacements in the warehouse.

    Not only that, seems like the CSR was willing to bypass the entrire
    testing process (which is also against policy with the exception of
    known issues, and int. mic issues aren't widespread with the 1010).

    They should have filled out a tech ticket, and had the techs look at it
    to see if they can duplicaqte the issue and/or if they can resolve it.
    If not, the CSR orderes a replacement phone when you came back.

    Sometimes if you give a little, they're willing to give a little. Its
    all bargaining. (But the CSR shouldn't have sent you on your way, he
    should have given it to the techs in the store)
