    You convientantly never mentioned how you handled the Samsung Black 8500's. You
    said they weren't defective because Samsung fixed them. So why didn't they put
    them in Gray cases then. Because they were reconditioned.

    If you sell reconditioned stuff as new thats fraud and I agree, it's illegal.

    Because there were other differences between the black 8500 and silver,
    like the silver had more phonebook entries. It wasn't just a simple
    case of putting a new color on it.

    If you want to start a lawsuit, go right ahead. Sprint PCS did this in
    every retail store they had, and I'm sure you'll get laughed out of
    court.

    (And "Some guy on the internet said..." is never a good defence in
    court)

    Wouldn't a reconditioned phone be a phone that was used, returned, then
    repaired, and resold. If that is the definition for a recon phone then
    those phones wouldn't be recon phones.

    Depends but by Techgeels account they were all sold as new.

    What he is trying to say is that the phones sold were probably ones that
    sprint never sold in the first place. They were probably sitting in a
    warehouse when the recall occured and samsung took them back and fixed
    the problem. At this point, yes the phones could be sold as new.

    About the 15hrs. That is the industry standard that all carriers must
    follow. Sprint's policy is that is the phone was activated it must be
    sold as reconditioned. Most carriers turn around and sell phones that
    people return under their 14 day return policy. Sprint phones must be
    sent back, checked to make sure they are ok and are then either sold as
    reconditioned or used in warranty replacement.

    None of this is illegal.

    Why would they not be considered new?

    No one ever used the phone, it sat in it's original packaging until sent
    back to the manufacturer in order to fix an issue. It was then
    repackaged and sold. Why would they be used?

    Interesting. Ford fixes recall issues on the cars still in their lots,=20
    and then still sells them as new. So does every automobile manufacturer=20
    on the planet that even does recalls.

    Are those cars no longer new also?

    What is up with 15 hours? I said the FCC regulations state any phone
    with less than 15 MINUTES of usage can still be sold as new, that is
    not Sprint's policy, that's the FCC's, if you don't like it, complain
    to them.

    Sprint PCS's policy on that is ONE MINUTE of usage, then it can not be
    sold as new, and since calls are rounded up to the next whole minute,
    then one call, even if it was a second, the phone would no longer be
    "new".

    what do you know about Sprint policy peckerhead. You don't even work
    for them. I would Like to see you post policy up here on this board
    (SPrint's policies are all online internally, if you know half the
    people you claim to then you should have no problem producing this)
