New phone without "new activation?"

Currently have a phone, Sprint month to month, and want to upgrade to a
newer model (Treo 700p). Good price at buy.com, but a "new activation
is required." Is it possible to buy a phone without activation? My
question assumes "new activation" means I can't keep my existing
number.

See my post a little further down. Mainly everyone says go to e-bay & buy a
used phone. Someone should start a class action anti-trust suit against
these phone companies who refuse to sell you a phone without activation or
extension of your contract. And they won't let anyone else sell you a phone
either.

Getting angry about something that you do not understand is a waste of
energy. First of all, the technology involved, CDMA, means that the phones
have to have special firmware to work on a carrier. That limits the choice
of phones. And this is not something that can be changed easily.
Plus, Sprint does sell the phones without a plan. They just cost more.
The carriers are in business to make money. They sell the phones at a
discount so that they can make money on the plans.
And the op is on month to month, so there is nothing to keep him from
moving to another carrier and getting a phone there.
