would they charge me for the data package if I use AT&T plan on a smart phone


I've been using Nokia E61i which is a smart phone for a while. I just switched from T-Mobile to AT&T today, but I didn't sign up for the $30 data package, which is required in order to use AT&T on any smart phone (their new policy starting last month). So I'm supposed to use the stupid Nokia 2600 they gave me for free.

I just tried to insert the AT&T SIM card into E61i, tried to call someone and apparently it works.

So, my question is, if I continue using it on E61i (or any smart phone), would AT&T automatically adds the data package to my bill and charge me for it?

I would say yes, but don't take my word for it. I would probably have to say if you start using any of the smart phones features (internet, email, etc) that require their server, it go from probably to for sure.

I you call someone on AT&T's system (maybe if you just have your phone on), they will know what you are using and charge you the monthly data fee.

I bought a Tilt from someone in April this year, and used it up until October with out being charged for a data plan. I never used the data part of the phone, only phone usage or wifi. The only reason it changed is that I added data, and upgraded to a Tilt 2. The whole time i was using it, if I went to the web page it showed the tilt as my current phone.
