    So I was due for an upgrade. I ended up getting a blackberry curve. Since I was not educated at all on data plans etc I didn't realize I HAD to get a data plan right away. When I called customer support they said they could reactivate my old phone/sim card and I could keep the BlackBerry and activate that when I want. My question is, whats stopping me from putting my old sim card in my BlackBerry? will at&t know/care that I am using my BlackBerry without a data plan?

    Once you put our SIM in your blackberry, the network detects it and automatically adds the data plan.

    Was this beyond the thirty days after upgrading? Once thirty days have elapsed, you cannot return the phone but you are bound by the contract to keep service for twenty-four months. Even if you do not use the BlackBerry device, your ETF of $325 is based upon your acquisition of that device as an upgrade. Your ETF reduces by $10 for each month the contract is in force.

    If it was fewer than thirty days you could have returned the phone with no ETF and reverted to the balance of your old contract. Remember that your upgrade eligibilty date usually comes before the end of your contract.

    About AT&T detecting the old SIM card, that's not a 100% true. Yes it can happen but they don't always detect it. I'm doing that right now with an iphone and a AT&T prepaid sim card with no issues.
