    some news :

    Dec. 04--Connecticut Attorney General Richard Blumenthal is pressing utility regulators to collect a $1.1 million fine they imposed against AT&T six months ago.

    "AT&T's stalling should be stopped, and the fine enforced," Blumenthal said. "This multibillion dollar company sought secret negotiations, cutting out my office and the public, to reduce its fine for failing to meet legally required service standards. We halted its concealment, and now AT&T should stop its delay in paying taxpayers the fine that it owes."

    The fine, if it remains at the current level, would be one of the largest ever imposed by the DPUC. The agency's action is the result of an investigation that began in April and found that AT&T had failed service standards for repairs every month between 2001 and 2009.

    One must remember that the various taxing jurisdictions did not tell the carrier that no taxes were due. The taxing jurisdictions are equally culpable. No retailer benefits from the collection of taxes.

    How did the case come to be before the U.S. Supreme Court?

    The Concepcions filed suit against AT&T in the U.S. District Court for the Southern District of California. The court combined their case a class action case known as Laster that raised the same issues. AT&T tried to get the case dismissed, arguing that its contract both required the Concepcions to resolve disputes through arbitration (which resolves the dispute outside of the court system) and forbid the Concepcions to pursue a class action. The district court refused to dismiss the case, and AT&T filed an appeal of that ruling to the 9th U.S. Circuit Court of Appeals. The 9th Circuit upheld the district court's opinion, and AT&T appealed to the U.S. Supreme Court.
