Hi i currently have a sony ericson that isnt a smart phone, so it does not need a data plan every month for 20-30 dollars. i want to upgrade my phone, and sell the new one and keep my sony. i was looking to buy it off amazon wireless, my question is, if i upgrade to a smart phone it makes me buy a service plan, so even if i dont activate the phone, do i still have to pay the new service charges since i am under contract or do i get to keep my old data plan? thanks

If you purchase from resellers such as Amazon, they require you to keep the phone and features in place on the line for at least 181 days to avoiid a chargeback for the instant rebate you were given. If you are planning to sell the phone rather than use it, you should purchase it from the carrier. The carrier does not require you to use the device purchased. You are not requred to keep any features associated with that device if you do not use it on the line.
These rules for device use applies to AT&T Mobility. Other carriers may have different rules. The reseller's rules apply to devices bought to use on any carrier they service.
