    No I managed to get my older Nokia 6680 fixed to allow me to lock it
    into 2.5G and only did so when required to avoid drop out in fringe areas.

    Although all the kiddies were wanking over Big Brother on their handsets
    sucking down all the bandwidth I would switch to GSM to get away from
    the congestion.

    No reason why I would want to have my handset locked to 2.5G all the
    time when I make moderate use of data services also. 3 Rip you on data
    charges whilst roaming to Telstra.

    Ummm, yes of course and is why they choose to deliberately disconnect
    the calls. No issue if you are driving through that fringe area and the
    call drops once, but when you are stationary and the handset sees 3G for
    only a few seconds each time it is a HUGE problem.

    Data downloading doesnt affect your voice calls

    Agreed, but depending on which network you are on as to how much data
    costs. Hence it is not in my personal interest have the handset locked
    to GSM all the time when I regularly download data.

    My original statements still stand. I was told repeatedly that there is
    no such menu to lock the phone into GSM or 3G on a Nokia N73. When I
    pushed the issue and spoke to the TIO, I was finally told by a 3
    representative that yes that menu *does* exist and has been *removed* by
    3 for *commercial* reasons.

    So in effect I was lied to until I pushed the issue and as a result 3
    have also taken a *commercial* decision instruct me to port my number
    within 7 days.

    I've always said the truth is out there, and it hurts!

    Whether or not Simon has a legitimate complaint, it's funny how 3 or any
    other telco for that matter, can deem it OK to terminate the contract if
    they see fit. But the consumer has no such rights.

    Contracts are supposed to be an agreement between two parties, each of
    which are to be seen as equal, That is, one does not have any adverse
    benefit over the other. It's a pity that doesn't extend to "commercial
    reasons"...

    The consumer has the same "rights" as the telco.

    BOTH the consumer and the telco are bound to the conditions enclosed.

    Except for where the telco can terminate the contract at any time
    without penalty, it seems. The customer doesn't have the same luxury of
    terminating it and returning the phone. He has to pay it out, as well as
    other penalties.

    Well, "Conduct Endangering Life" is extremely serious - maybe they know they
    are dealing with a fool and choose to ignore you.

    I suggest waiting 7 days for a response to such an intellectual question
    would be unacceptable. Maybe you should contact them yourself?
