The talk and courts are now discussing whether or not texting on a business OWN cell phone is private and personal, should companies not be allow to read or monitor a employees text messages, or can a business/company read and monitor your text messages since they own the phone and pay for all services of the cell phone.

I think a company checking your emails on a desktop/laptop computer isn't as personal as giving you a cell phone in which you carry 24/7 on your person which enhances more of a chance to use on a non-business level.
Your right about eye balling your emails, matter of fact a person at my wife's job (large Company) was fired spending time on x-rated/sex websites.
I never had a business issue cell phone so i don't know or, if any pre-determined restrictions comes with it. A friend of mind (i will ask) works for a company that issue him a Blackberry, i know he uses it for personal use because he emails me family photos and stuff.
Now if he does have permission to use it for both personal and business purposes, can his personal use of his Blackberry be viewed and/or used against him if the company sees questionable information on it.

The difference is your email content is physically stored on your company's server and they have access to it.
Text messages are archived on a phone carrier's server and the company does not have access to it.
Can they ask for it to be published along with their phone bills?
Can they also ask for web sites that were visited on their data plan to be published on their phone bills?
