The other day after a block party I found a Motorola v400 camera phone on the curb. I know I can take my SIM card and put it in there, but is there anyway they would be able to trace it down? or know its a stolen/lost phone?

What you should do is power it on, see who's phone it is... and turn it in. Or drop it off at a cingular store.
However, if you feel like taking somethign that doesn't belong to you, you can use your SIM card. Cingular does do audits once in a while and the phone is constantly sending data back to the towers. If the person reported it stolen, you bet they can track you. And when they find you they'll assume you're the one who stole it. If they reported it lost/broken, you might be able to use it, but cingular may still look for it. Use at your own risk.
