Fido offered me an iPhone and is trying to back out. Can I cancel contract?


Hey all,

Fido has really screwed me over lately. My iPhone was stolen so I managed to find a fido phone online which I was going to buy. But I called Fido to ask if I should go ahead and do it first... The fido rep actually told me I could get a new iPhone 3GS for $200 if I add a data plan to my existing phone contract... This sounded great but it would also take nearly two months for the iPhone to arrive. I called back several times during this period to insure that it was on route and they confirmed it was indeed on the way. I also rented an iPhone from a friend for the two months.

Finally, around a week after when the phone is supposed to have arrived, I call them back and and ask what's up and they tell me that the offer wasn't valid and they can't do anything for me.

At this point I've probably spent $400 or more on unneeded services and a phone rental.

They offered to modify the contract to include the new iPhone, not me, so I feel I'm entitled to leave without a cancellation fee. Any thoughts on this? I've already talked to a rep->supervisor->manager and they aren't willing to budge at all. I said I wanted the iPhone as promised or to cancel my contract.

Any thoughts of what I can do. They also offered me a measly credit.

Well, Fido offered you a fairly good deal at first and I KNOW it isn't something they would normally do, therefore if it's something they can't do now...the CANNOT and DO NOT have to do it.

You could try and have them review notes in the account and see if that helps

Hey there. Thanks for your reply. Well I've talked to a friend that has received a similar renewal and he did indeed get a new iPhone. So that answers the question of if they cannot do it; certainly they can, and have. Whether they do not have to do it, that's what I'm questioning here. My past iphone was signed up for over the phone in the exact same manner and that according to fido constituted a verbal contract. They also had plenty of time to get out of this contract when I called to verify it over the course of two months and they insisted it was indeed correct and the phone was on the way.

One has to question the motives here too. They had a lot to gain from charging me ridiculous call forwarding charges and other fees while I waited for this new phone.

I'm contenting they are breaking our verbal contract here and I have the right to walk away.

Do you not agree?

Try contacting the president of the company.Usually an assistant will handle it and if they promised you something and retained your business for it the definitely owe you something.You just have to keep fighting and log all you conversation Time,Date Name of person you spoke to and employee number.The more you call and complain the further you will get.
