Hi all! I received an email to the email address that I have registered
with tracfone. Text of the message is below. Attached were three
documents of court filings.
I had purchased some tracfone airtime on ebay in 2005, from a user
named "larryscell". Apparently, he was involved in some illegal stuff
with tracfone, as one of the court filings involved him.
I'm assuming that my purchase of airtime is how my name (or email) got
connected to all this. Am I in trouble here?
Thanks!
Text of email:
You have been identified as a possible participant in an enterprise
that is purchasing large quantities of TracFone wireless phones for
purposes of hacking, unlocking, and resale. TracFone has been
significantly harmed by this misconduct, which we believe constitutes
fraud and violates numerous state and federal laws providing for civil
and criminal liability. TracFone has filed civil lawsuits against
people and companies who have engaged in this unlawful practice and
TracFone's internal security department is cooperating with federal,
state, and local law enforcement agencies across the country to
investigate the perpetrators of these crimes and bring them to justice.
The FBI and United States Attorney's Office has begun criminal
prosecution against several people who were caught with large
quantities of TracFone wireless phones. Examples of a civil complaint
filed by TracFone, a federal court injunction obtained by TracFone, and
a criminal complaint filed by the government are attached above.
The purpose of this email is to warn you that participation in these
schemes exposes you to potential civil and criminal liability, and to
demand that if you are involved in such activity, you immediately cease
all illegal purchasing, unlocking and/or reselling of TracFone wireless
phones. Should you wish to cooperate in TracFone's investigation, or
if you have information about others who may be involved in these
activities, we urge you to contact TracFone's security department by
responding to this email or calling (866) 806-1838, or contact your
nearest FBI office.
You will not receive another warning.

JoshIII responds:
I would email TracFone Security and ask (if you thought larryscell was legit
when you made the purchases).
If you had reason to believe purchasing airtime at half price was
illegal at the time, then depending on how much half priced airtime you
purchased off ebay (whatever), you might want to retain an attorney.
TracFone website is lacking on keeping subscribers aware of scams.
Its not always obvious to the unsuspecting subscriber what online
"dealers" are legal and which ones are using hacking methods to
obtain and sell PINs.
Rule of thumb: If "dealer" has to know your ESN before they will
sell you airtime, I would stay away from them.
Good luck!

Re: Message from tracfone security?
Now I understand.
The FBI had arrested a couple of dudes with a thousand tracfones in
their possession after they bought several at a Walmart.
..
They suspected the phones were used by terroists either to blow up
IED bombs or else just to communicate without tracing.
Then they let them go and said they were not terrorists, just a
couple of guys trying to make a profit.
Now I see why they could sell their tracfones at a profit......
It all makes sense now.
