Can you help me PLEASE I am so frustrated you have no idea

I have a brand new KS360 and it does not hold charge, you charge it for its 8hrs - take it off at 6am in the morning and by that night (same night) 10pm the phone is dead - the battery has gone flat. This phone has stood on "standby" all day with no activity on it, no calls to or from, no messages either. My local rep cannot understand
