having trouble turning my new hs850 headset on and off--please help!!

I have had the black razr v3 from cingular now for a couple of weeks and love it. Yesterday I got the hs850 bluetooth. I charged it for two hours, worked on it for a few minutes and got it to pair with my v3 and went to bed. Got up today to play around with my new bluetooth headset again, and I couldn't get it to power on. Your supposed to be able to open the boom and it turns on. I've played around with it and the phone and have come to the conclusion it is the headset. For some reason it powers on and off (when it wants to) by flipping the movable earpiece. I finally got it to stay on and used it for several calls with no problem. Then I took it off and tried to turn it off by closing the boom and it just stayed on. I then went back to moving the earpiece around again and it finally went off. Now It won't come back on??!!! any suggestions?? I bought it on ebay
