My husband and I are on a business plan at U.S. Cellular. I have an LG Banter touch right now and hate it. He wont let me upgrade to a smartphone because I don't really need one, but there are no nice non-smartphones to choose from. My question is, he just upgraded from the old Samsung Galaxy 2 to the new Galaxy 3, can I use his old phone without the smartphone package?

I don't believe you can since US Cellular uses the CDMA version of the Galaxy S II.

As far as I know, most carriers require a data plan with smartphones. You'd need to call U.S Cellular to ask them if you could add it without a data plan.

But all U.S. Cellular phones are CDMA.

If it's a U.S Cellular phone that you want to upgrade to, there shouldn't be a problem. The problem is when people purchase a phone that isn't compatible with the network, such as a GSM phone, or when a phone needs to be flashed. In regards to the data, they might require a data package. You'd need to call U.S Cellular to find out. You can also try switching to the phone online, if U.S Cellular allows their customer to do that online. If it requires a data package it should tell you.
