Need HELP!!!

Well my first question is that my brother is going to buy a phone for me and he wants to get the new line discount for the phone. I want the Sidekick LX wich cost 400 and wit the new line discount its 100. He has 4 lines and he is giving me 1 of them because my mom wants to give it to me. My question is if he can close the line and open a new one in order to get the new line discount.

Oh and my second question is that if i dont get the Sidekick LX with the Web plan and just the 40 doller unlimited plan is it true that the phone wont work properly?
