n70 firmware upgrade

Having some proplems with this phone which i understand may be due to
fimware, the phone is from '3', are they liable to have it upgraded or is
this my responsibility?

its a warranty issue. if you have problems which may be fixed by
upgrading the firmware (assuming there is a newer one out) you can
refer it back to Three or take it to any Nokia service centre and they
should do it free of charge.
