Bit of an oddball query, and I suspect i`ve got zero chance of this,
but...
I`ve currently got 2 phones on O2 200 (£30 per month each) - several
months ago I received something through the mail from CPW/O2 about my
usage, and offering to change the tariff to something around £15 per
month based on my usage.
There was a shortcode number to send a message to in order to accept the
reduced tariff, which I did for one of the phones.
I`m still being charged full whack on both phones - now, I haven`t got
itemised billing, but while I was having a clearout of junk I came
across the letter which reminded me.
What do you think the chances are of being able to claim a refund of the
additional charges taken "in error" since - and would I stand a chance
of getting them to confirm I sent the message at the time (proving their
overcharging) if they deny it, by using a request for information under
the Data Protection Act, despite not having itemised billing ?

Wrong group, see uk.legal or see a solicitor. Some might help you to get
something you're not entitled to.

I would advise the OP to ignore John, who is a useless overweight
mesogenistic bastard.
Colin, contact o2 and simply say that you have been overcharged. Never send
the original letter to the party, just send a recorded-delivery copy of the
bill, if o2 even request it, which they may not.
In these sort of matters the companies will usualy want to do their best -
if met by objection simply ask to speak to a supervisor, and don't use
premium rate lines to make your objection. First object, then complain, be
nice at all times. Building rapport with the person you're on the phone
informing of the situation will have a much better effect than shouting and
making them feel they are being harassed.

IIRC the info about downgrading the tariff may have actually come with
the bill, but with them not being itemised its hard for me to prove I
sent it at the time.

I`ll give it a go on Monday - possibly more chance of getting someone
other than a call centre drone (not that I have anything against people
stuck in call centres - its a job, after all)
Its not that big an issue for me money-wise, so even if they dropped it
to the other tariff "now" there`s no real problem - i`ve just found
myself slightly shorter of cash than normal, and a few months worth of
£15 refunds would come in handy atm :-}

I missed customer services, but I also used the "if you want to cancel"
option with a view to finding out how hard it was to drop to PAYG
I was offered 400 mins per month (O2 & landline) with NO LINE RENTAL for
12 months !
