    Hi,

    Last night I either lost my phone or it had been stolen or nicked, I am not
    sure as in the morning I just didn't have it. I was in a pub and then walked
    home. I don;t know at which point it had disappeared. It was insured as it
    was XDA MINI S, worth around £400.

    I am going to go to the police to report it but not sure what? Lost, stolen?
    I don't know.

    I obviously want to have it replaced, but my policy says there are
    exclusions such as it doesn't cover 'theft from any property, place or
    premises unless such theft or damage has occured through forced and violent
    entry or exit' and 'theft from the person is not covered unless force or
    threat of violence is used'.

    Does it mean that the policy doesn't cover what happened to me? Does it
    cover only thefts with use or threat of violence? It is £6.50 per month
    insurance, so I think it should cover accidental loss or theft like
    pickpocketing or theft from bar table or anything like that.

    What should I do to get it replaced? I am about to go to the police station
    but unsure what to tell them.

    The insurer is Citymain Administrators, mobile from o2.

    Any advice would be greatly appreciated.

    >From your description of the exclusions, it doesn't sound as if it will

    be covered - sounds like they will cover muggings but not pickpocketing
    or any other kind of mysterious disappearance. It's hard to tell though
    without seeing the full policy wording but doesn't look like you're
    going to have much luck getting it replaced under the insurance.

    Well, I would go with the old, it must have been pick pocketd then.
    That way it'll definatly be blocked and whoever found it wont be able to
    use it, as you never know, it could have been picked out of your pocket.

    That way the insurance company have a definitive answer, stolen.

    I've only ever made 2 claims on my insurance and on both occasions it
    was the same kind of circumstances as yourself and I really didn't know
    if I had lost it, or if it'd been stolen, and last I remember it was in
    my pocket. Both claims were accepted.

    Ah, I didn't read that bit properly.

    So, it doesn't cover theft from the person unless someone threatens you,
    ok, so it doesn't say anything about losing it though does it? One
    minute you had it, the next you couldn't find it, might be best to go
    down that route?

    In my younger days when I had lack of funds, and perhaps had an essential
    item, then if I had to I would have said I was mugged when I wasn't
    perhaps... It never happened, but many policies have stupid get out clauses.

    In future Mr.Polzek use your home contents' insurance, rather than a
    seperate mobile insurance policy - they are a ripoff.

    Insurance typically covers everything until you make a claim.

    Also some don't cover "high risk" premises such as pubs and theme parks.

    I'm not sure I understand the difference between these two.

    However, either way, it sounds to me as if you are not covered.

    My advice remains the same: don't waste your money on mobile phone
    insurance.

    You may well find that you're covered by your household insurance in
    any case.

    ....ah, but only if you have the All Risks section active. I do (and
    was glad I did when my cameras were stolen) but you'd be surprised by
    how many people think it is not necessary/expensive so don't.

    I work in a theme park and the amount of mobiles people just leave is
    unreal.

    Likewise on the buses. I work for a bus company and at least one or two
    are left every day on the buses at our garage alone. I was in the office
    once when one was handed in a couple of weeks ago, my manager was there as
    well and decided to ring up the number under "home" in the phonebook and
    tell the owner their phone had been found. He soon wished he'd not
    bothered as whoever was on the other end couldn't speak English very well
    and it took him the best part of 5 minutes to explain to her how to get to
    the garage to collect it..!

    I`ve had days like that from 9am to 5pm... i`m sure he felt good about
    doing the right thing though :-)
