Ebay; when does a new phone become used?


Hi, I just bought an Motorola L7 for one of the boys, it was advertised
brand new.., but when we got it there were fingerprints on the handset
and and screen and dust in some of the grooves between the keys, also
the battery and manuals etc. weren't wrapped in cellophane... to me
this had clearly been used. Contacted the seller and he said it was
brand new, and then told me to take a running jump if I wasn't happy.

Correspondingly, I have sold many phones on ebay and to me 'NEW' is
when you open the box having just bought it from the shop and
everything is in-tact with the plastic on the phone screen and
everything in wrapping; and 'USED' is that you've been using it whether
it's for a day or several months, even if you have all the gubbings.

Did you pay by paypal? If so, you can file a complaint with paypal. That
will get his attention...

eBay say:

I take that to mean that it doesn't *have* to be in a "just out of the
shop" condition but that it is obvious that it hasn't been used "in
anger" - I would accept as new a device that has been removed from the box
to see if it worked but not one that had obviously had any serious use.

Agreed. I would consider a day's use (burn-in testing) to be new.
Fingerprints on the screen wouldn't cause me alarm, but dust in the
keys might. They surely indicates prolonged use.

As a seller of phones (about 15 per month) fingerprints on the screen would
definitely mean used/secondhand. The screen protector should still be in
place if it's new.

A number of phones are bought as presents and you would expect the recipient
to receive it in such a condition that they thought it was new.

If you have to remove the phone to unlock it, all packaging should be
retained and re-boxed as was and the screen proctectors left intact, plus
any fingerprints from handling it should be wiped off with a soft cloth.
Ideally you should have your own replacement lables to put over the broken
security labels.

It's not brand new then. You can slo check the life timer. If the
listing says "brand new" and it does not seem so, that's false
advertising. You should give appropriate feedback.

You've been ripped off. You've paid the brand new price for a phone that
clearly isn't. To me, if the packaging has been opened (to check that
everything was there and take the pictures for example) and the phone
switched on once (to check that it's working and maybe enter an unlock
pin), it still can be sold as brand new. But it the screen protector has
been removed and/or dust can be seen on the phone, this clearly isn't in
brand new condition. If the seller refuses to either give you a financial
compensation or refund you, you can fill in a complaint with eBay and
paypal and leave the seller a negative feedback (keeping in mind that,
unfortunately, he'll probably red you in return).

That's the problem with leaving negative feedback, the person who's
messing you about can hurt you back. Some Herbert took my phone off
sale with a Buy it Now option a couple of months ago.., after a week of
no money and no communication I left a 'beware of this seller type
warning message' and guess what, he left me negative feedback along the
lines of "F*** off you gay faggit, who wants to buy your **** phone
anyway" --- it took me about 6-weeks to get this removed. Ebay aren't
very dynamic when it comes to other people messing up your feedback.

Give him/her some negative or file a dispute.

That's not what you said several months ago when we were debating the
opening of a mobile phone box in order to show the customer. You stated
that having been shown the mobile you would then insist on a sealed one
for yourself.

That was buying from a shop. We are discussing buying from eBay.

Yeah I have paid for stuff straight away with pay pal yet some sellers
wait until you leave them feedback before they leave you any. surely
they should leave theirs as soon as they receive payment.

Scammers are not always the sellers. Buyers can be assholes too claim that
the item has never been sent or wasn't as described which is why it's
always safer to wait until the transaction has been fully completed and
make sure that the buyer is happy before leaving feedback.

The lifetime timer tells you how many hours the phone has been used for
and it cannot be reset easily if at all.

On my V551 it's under Tools->Recent Calls->call time.

My phone shows 06:25:39 (6 hours 25 minutes and 39 seconds)

Check your phone for something similar.
