    hi there,

    i have one of those contracts with 2000 txts that i will never use

    i will probably have 1800+ text left on the last day of the month

    i want to send them all to one friend who borrowed something from me and is
    taking ages to return it, so he will "get the message" haha

    i can send them quite easily using Nokia PC Suite,

    could I get into any trouble? apart from him moaning at me

    If he complained to the police you would be. Various telecommunications
    acts and offences against the person act to start with. You could be
    prosecuted if your friend was very annoyed. Why not just speak to him
    instead, use some of your free minutes.

    Go for it, you could say your phone had a 'bug' and this had happened
    before, or some other such nonsense.

    this.

    All networks have similar terms and conditions, but Orange say:

    5.1 Recognising that good management and security of the Services is
    important to all Orange customers you will agree that you will:
    5.1.1 not use the Services for any improper, immoral, fraudulent or
    unlawful purposes or for the sending of any communication or storing of
    any information which is of an offensive, abusive, indecent, obscene or
    menacing nature;
    5.1.2 not cause, nor knowingly allow others to cause, any nuisance
    annoyance or inconvenience whether to us or to any of our customers
    which shall include the use of the Network for the persistent sending of
    unsolicited communications without reasonable cause;




    I think sending 1,800 text messages to a single recipient so he "gets
    the message" would constitute being a nuisance, which they then can do:

    2.6 We may Suspend the Services in whole or part at any time without
    notice if we have good reason to believe you haven't complied with one
    or more of these terms and conditions or if any money owed by you to us
    whether in relation to Services or not remains unpaid.
    2.7 We shall investigate all complaints made whether by or against you
    and reserve the right to Suspend the Services if a complaint has been
    made against you pending the results of investigation of the complaint.


    Plus, apparently, sending just 165 messages per second is enough to jam
    cellphones for the whole size of Manhattan...

    If he's got a Nokia, I'm sure they'll believe that the same message was sent
    1600 times. It'd be pretty funny, don't think they'll even notice, let's be
    honest.

    The worst one was when a mate of mine sent some dirty messages from my
    mobile to his partner at the time. I called vodafone the next day regarding
    something else, and they commented on sending abusive text via text message.
    The guy said they can see the past 50 messages you have sent, and more if
    required.

    ironically, cowboy scammers can repeatedly send thousands and thousands
    of unsolicted reverse-charged MMS messages at £1.50 a throw with
    apparent impunity but I can guarantee that if you do what you are
    considering you'll find yourself in hot water.

    Protection from Harassment Act 1997

    1. - (1) A person must not pursue a course of conduct-

    (a) which amounts to harassment of another, and
    (b) which he knows or ought to know amounts to harassment of
    the other.

    (2) For the purposes of this section, the person whose course of
    conduct is in question ought to know that it amounts to harassment of
    another if a reasonable person in possession of the same information
    would think the course of conduct amounted to harassment of the other.

    (3) A "course of conduct" must involve conduct on at least two occasions.

    So you can be in trouble by the third text, First is a reminder, second and
    third (if sent unreasonably soon) could make it harassment. Send a
    hundred and 'a reasonable person' is likely to view it as harassment.

    Rubbish. The analysis linked to is flawed. The mobile networks
    reserve 'slots' (by algorithm, vs. specific quantity) to limit the
    amount of SMS delivered from any one cell to prevent such
    denial-of-service happening.

    In addition, the sending of texts from the mobile into the network (vs.
    the delivery) is also controlled in such a manner.
