the way our law is its no different, its the phone call itself that

SWMBO told me about a colleague she had to drive in to work (because the
colleague was injured). Colleague is an utter liability with vague
directions and, when they're misinterpreted, flailing arms so obscuring
the passenger side mirror and general panic causing sufficient
distraction to come within an ace of causing an accident. Any more of
that and injured colleague will find herself getting a taxi into work.

I dont fancy a lump of plastic stuck to my ear, and its nothing to do with
money, its to do with looking like a twat. I drive a "30K" car, and wont
waste my money on a bluetooth earpiece. My phone has a loudspeaker built-in
so I just use that. I do however use common sense on whether I tell the
caller I will call them back, or actually take the call. I will read text
mesasge whilst driving, but will never write a text mesage whilst driving.
However thats to do with the fact I rather phone than send a text.
Lets face it the mobile phone law, is another money making scheme. Its got
nothing to do with safety. I can quite happily program my sat nav device
(which is more distracting), and I wont be breaking the law.
I have been driving and have had a mobile phone for over ten years. Luckily
I have not had an accident whilst on the phone. I have however had two
accidents whilst I have not been on the phone. Therefore it is logical to
conclude, for me, it is safer to drive whilst I am on the phone.

One simple and fair solution would be to mandate installation of a
'black box' recorder taking input from forward and backward pointing
miniature video cameras, a decelerometer and possibly other sensors
which stores the last minute leading up to an accident. The recording
would be encrypted and readable only by the police (and made available
to the insurance company), so there should be no very serious privacy
concerns. In the event of an accident and the recording being frozen,
the video evidence would be reviewed. If it showed that the driver was
not paying due attention to the road ahead for any reason, including
(but not limited to) mobile phone use or changing gear, she would be
liable to prosecution and penalties vis a vis insurance. Of course, it
could also be used to exonerate blameless drivers.
For many drivers, the knowledge that negligence is more likely to be
detected would encourage safer driving. It is unlikely to change the
behaviour of the truly stupid, but it would make them more accountable
for the fruits of their stupidity.
Such a scheme would not be cheap. However, if it saves the life of one
child etc.
