    Anyone know who this bunch of ****wits is without my calling 10p a

    You said it yourself, so why bother calling them, the scam is national rate
    0871 numbers not being techically premium rate are exempt from what
    little spamming legislation there is

    BTW calling so called national rate 0871 from most mobiles
    is a lot more than 10p, hence their incentive.

    Just another example of how OFcon is protecting us, not.

    Yes, but I want to send them a couple of nice letters, then a summons
    for it... Lets see - £300 would compensate me :-)

    It was illegal for them to send it to me - why shouldn't I seek
    compensation for their illegal act?

    Because you haven't suffered as a result. It's a basic tenet in law that
    you must prove loss to claim compensation.

    Now if you'd been stupid enough to call the number then you could take
    them to court and request punitive damages way in excess of the actual
    loss once it came to judgement, but as far as I know (IANAL, obviously)
    you can't get to that stage without proving some loss.

    Which country will you serve this summons in?

    I doubt you can hold Vodafone Egypt responsible for the conduct of one
    of their customers, or force them to tell you the miscreant's
    whereabouts. And that's if the caller ID is genuine, and even so the
    texts will have been sent via another carrier

    You could approach the provider of the 0871 number - you'll probably
    hear that their client has told them the number is used for market
    research

    As the research consists only of finding out how many gullible people
    will call it, and you haven't been susceptible, I think you'd have a
    job proving any losses at all, beyond the time you spent writing here,
    for which nobody is likely to assume liability as the law obliges you
    to mitigate your losses

    I just had one of those today on my Tesco SIM. I sent it to 7726, the same
    number as Orange use for spam reporting, although what they'll do with it
    is anyone's guess.

    I have suffered through the irritation I was caused. It forced me to take
    time out to deal with it and caused me distress as a result..!

    I have suffered inter-alia the cost of dealing with the illegal
    actions of ALL spammers, whether by email or SMS.
