12 WPM Class A who passed after 12 years, 6 months and 17 attempts!
    Guest
So I ordered an N96 from the Carphone Wharehouse's internet store,
    mobiles.co.uk the other day.

When it arrived I noticed that the box had been opened, and, inspecting the
phone, noticed that the screen was missing its nice new plastic film
protector and it was covered in finger prints. So I rang up to complain..

'Oh, you need to speak to Returns, I can see their desks and no-one is on a
call - you should get through immediately'

So naturally nobody answers for at least 4 minutes...

    'Yeah?'

    Is that Returns?

'Oh - yes, this is returns'

Why is my phone second hand etc...

'well sir, we open the boxes to make sure the phone works...' bs bs etc

so why is the plastic film missing from the screen? And where were all he
games that were supposed to be preloaded on it?

repeat 'well sir, we open the boxes to make sure the phone works... you need
    to speak to returns'

You just told me you were returns!!

    etc etc...

    Further bs ensues...

So I decide to mull over keeping or sending the phone back, and while doing
that, hook it up to my pc.. And I find a whole bunch of out of focus photos
of the previous owners kids, dated 1 August 2008!!!

Now, I'm sure selling a secondhand phone which was guaranteed to be new with
photos of the previous owners kids is a data protection issue, but the phone
wasn't on general release in the UK on the date the photos were taken, so is
this a grey import as well??!!

I've been working away for the last few days so I have missed the deadline
    to send the phone back..

    Be careful about mobiles.co.uk!!!

Possibly August 1st 2008 is the default date when you switch it on? Or
it could well be grey job. CPW do it all the time.

Nope, try Trading Standards... you could always transfer some filth
onto it before contacting them to really stitch CPW up, but make sure
you have the file dates tweaked as appropriate

Prove you didn't put an old phone belong to your mate in the box.
You can be caught out if the phone is inspected, so don't lie as the
photos will have data within the files showing when they were created,
copied, opened, and other hidden stuff!

If you were SO bothered you would have returned it instead of
making the excuse about working away.

Would it be any less dishonest than the vendor selling second hand
    goods ?

I thought from his message that the original idea was to get it replaced
by a new phone as contracted.

It should not be difficult to identify the original owner then follow
the paper / electronic trail of its return to the company and disposal
by them. If they claim to have sent a new phone then they should have
    serial numbers etc.

Ah, you're one of the '2 wrongs make a right' group. Luckily not everyone is as vindictive as you appear to be.
