    Do you think that's fair?
    I don't think so.
    I bought my Motorola Model V400 GSM brand new,
    out of the box, I still have the box, with Cingular stamped
    on the upper right hand corner.
    I did pay $200.00 for it, I gave up on the Cingular promised rebate.
    I didn't buy a 2nd hand phone, so why should Cingular replace
    their cellphone with a 2nd hand phone.
    It is their warranty.

    I do notice, that the cellphone they sent me doesn't have to be
    charged as often as the brand new one I bought.

    I think it's quite reasonable as long as its disclosed in advance.

    It's actually a Motorola warranty. If you prefer, deal directly with
    Motorola.

    My experience is that the quality of reconditioned products is often *better*
    than new products -- they tend to be subjected to more rigorous quality
    control.

    You mean Cingular sells its customers 2nd hand cellphones?

    Because I bought the phone brandnew from a Cingular Authorized Dealer.

    No they don't. But the phone that you sent them was not new it was 7 months
    old and evidently a piece of ****. The new refurb you recieved from them by
    your own admission is working better so why are you still *****ing?

    Well you're right, the original Motorola V400GSM, that I purchased
    for $200.00 from the Cingular Authorized Dealer, brandnew in the box,
    needed to be charged on a daily basis, sometimes twice a day.

    I was mystified, because I saw my sister with her Sprint phone
    and others with their Verizon phone, and they charged every three days
    or so.

    This 2nd hand phone, Cingular sent me as a replacement phone,
    for my brandnew, under Cingular warranty phone, needs to be
    charge every other day.

    Hasn't said Low Battery yet.

    If you buy expensive phones like a RAZR or Blackberry you will not have
    this problem. (snicker)

    Warranty yes but no insurance on the RAZR maybe in March you can get
    insurance.

    No John, What I meant was that you cannot get the insurance policy on
    any of the phones that are reasonably expensive.
