After months of following up my $200 rebates for a Motorola RAZR V3
phone from Wirefly, I still have not received my promised rebate from
InPhonic, Inc., which appears to be their mother company. They claim
they are reprocessing my submission with a new service provider, but so
far, nothing. These are the Customer Loyalty rebates for $100 and
    Customer Appreciation rebates for $100.

They have a number (866)-607-9877 which is always busy, which means
either they left it off the hook or the number is disconnected. I tried
calling in the evening and I get the standard "all operators are busy,
your call is important to us", and I wait for an hour and nobody ever
comes back to me. Cingular is washing their hands off, and Wirefly just
keeps referring me to this dead number or to their equally dead website
    www.cellphonerebates.com.

Has anyone had the same frustrating experience and is there anything I
can about short of going postal? http://InPhonic.rebatestatus.com and
    www.cellphonerebates.com and www.rebate-zone.com all are
non-responsive. And I'm disappointed with Cingular, because these
rebates are supposed to be rewards for my being loyal to them,
stringing me up for a six-month wait and a 2-year service contract, yet
they claim they have nothing to do with Wirefly.

I tried e-mailing Wirefly directly and no response at all.

I am an attorney and I am thinking of suing these bastards and I want
to know from fellow lawyers out there which court(s) have jurisdiction
over this matter, who should I name as defendants, how much and what
kind of damages should I seek, etc. But if someone has a less drastic
approach to getting this matter resolved, I am listening eagerly.

    Thanks for any guidance.

You are a practicing attorney? Hopefully not in New York State.
Basic premise is to first contact the rebate house (you listed above) for a
physical address. If not based in your home state you are SOL. If they are
in your home state you can do the "Small Claims Court" you pay a small fee
    based on your suite.

If others are involved you could press a class action in a federal/state
supreme court citing fraud etc. on the part of the rebate company. You could
also if Cingular was the company that offered the rebates via their website,
customer service department or some other venue take them to court for not
    honoring their rebates.

Again any "attorney" would simply send a certified letter on their office
letterhead alerting the legal department of your impending actions. But
don't just threaten, do it! Barratry is also a no no when doing these
    actions.

You could also pursue the matter with your states Attorney Generals Office
    (Consumer Frauds and Protections Department)

    Hi, Indio Bravo:

I'm sorry to hear that you've had difficulty contacting Wirefly through
our dedicated hotline. I invite you to contact me directly, via e-mail,
and I'll immediately look into your specific rebate case. If you
provide me with your order number, I'll be able to track down your
info, and get back to you ASAP with an update.

I hope I'm able to help,
