    The FTC seems to be interested in this issue. (It's about time!) Go to the
    FTC web site (www.ftc.gov) and search (in the upper right hand corner) for
    "rebates".

    Decided to write a letter to my favorite online retailer to let them
    know I will no longer make any purchases from them. Here's what it
    says.....

    Dear Amazon.com,

    It has come to my attention that you have partnered up with InPhonic
    to market products. This company is well known for its illegal
    business practices... namely cell phone rebate fraud. I just happen to
    be one of the victims of Inphonic and the phoney rebates it offered
    and I have not received. I have reported this crime to the BBB and
    FTC, as well as several online groups.

    As a result of this crime (fraud), I will not conduct business with
    any company that has partnered up with InPhonic, this includes
    Amazon.com. ALSO, I have told all of my family, friends and business
    associates, and online friends NOT to do business with Amazon.com and
    I will not accept gift certificates for Amazon.com, so they need to
    find another source for Christmas gifts.


    I would hope that Amazon.com would reconsider partnering up with a
    scam business like InPhonic as more and more people become aware of
    this problem company. BTW, I will be posting this reply to several
    newsgroups on the internet as well.

    I'd contact the State AG in Minnesota and the FTC with a Certfied copy
    to inPhonic.

    Dear AT&T,

    I would like to bring to your attention criminal activity involving
    one of your retailers, InPhonic. As you may be aware, the Better
    Business Bureau has a very long report on InPhonic (

    According to this report, InPhonic has been using several business

    According to this report , June 8, 2006 the Attorney General of
    Washington DC filed suit in Superior Court against InPhonic. Also,
    April 27, 2007 Federal Trade Commission suit claiming deceptive and
    unfair business practices regarding rebate offers. No surprise,
    InPhonic is very well known for it's illegal and deceptive business
    practices in the industry... namely cell phone rebate fraud.

    I just happen to be a recent victim of Inphonic and the phoney rebates
    it offers.... I have not received the rebates that I was promised when
    I purchased the phone from LowCostCells online and I agreed to the 2
    year plan with Cingular / AT&T. I have been waiting for almost a year
    for 2 rebates to arrive from InPhonic. I have been watching the
    InPhonic website that shows the status of the rebate ( http://cellphonerebates.com/
    ). Here's what it's been telling me for almost 6 months:

    "Claim approved. Payment pending, please allow 4-5 weeks for payment
    processing. If you have any questions or concerns, please contact us
    by calling (866) 607-9877 or email us at [email protected]."


    The InPhonic Rebate Center no longer replies to my emails and I have
    reported this crime to the BBB, FTC,the Attorney General, as well as
    several online groups.


    As a result of this crime (fraud) against me, I will not conduct
    business with any company that has partnered up with InPhonic, this
    includes AT&T. I intend to finish the 2 year contract as I promised,
    but if this crime is not properly dealt with by AT&T, I cannot
    continue as a customer after that.

    I would hope that AT&T would do the right thing and reconsider
    partnering up with a scam business like InPhonic. As more and more
    people become a victim of this rebate fraud, I do believe that AT&T
    will lose customers as a result.

    InPhonic, Inc. (NASDAQ:INPC), a leading online seller of wireless
    services and products, today announced that it has entered into an
    agreement to sell substantially all of its assets to an affiliate of
    Versa Capital Management, a Philadelphia based private equity firm.

    In order to implement the sale, InPhonic filed a voluntary petition
    for reorganization under Chapter 11 of the United States Bankruptcy
    Code in the United States Bankruptcy Court for the District of
    Delaware. InPhonic's Board of Directors has unanimously determined
    that the Chapter 11 process will provide an efficient environment for
    completion of the sale. The sale is subject to higher and better
    offers, and InPhonic anticipates completing the sale before the end of
    the year, subject to court approval. InPhonic will continue to conduct
    normal business operations at all of its facilities consistent with
    its obligations as a Chapter 11 debtor-in-possession.

    Versa will also be providing a Debtor-in-Possession ("DIP") financing
    facility to provide working capital and financial resources necessary
    to fund the transition in operations to new ownership pending court
    approval of the sale to Versa.

    The Company's recently appointed management team believes that this
    expedited process is necessary to promptly institute its improved
    business plan and that the filing and sale are in the best long-term
    interest of the Company, as well as its customers, partners, vendors
    and employees. Lazard Middle Market, the Company's financial advisor,
    is assisting the board through this process.

    "We intend to use this filing to take the actions necessary to
    position InPhonic for future success. We want to assure our customers,
    our employees and our partners that InPhonic is operating business as
    usual during this transition," said Andy Zeinfeld, InPhonic's Chief

    implemented across the organization. The new direction I have set is

    in the wireless marketplace and through this sale to Versa, it will
    operate on stable financial footing and its leading role will be
    preserved."

    Ken Schwarz, InPhonic's Chief Financial Officer added, "This sale will
    strengthen the Company and foster a sustained turnaround for InPhonic.
    This milestone marks a fundamental, comprehensive and systemic change
    at InPhonic. Our customers, partners and employees want the Company to
    succeed because of InPhonic's significant value in the wireless
    marketplace. We expect to proceed quickly with this sale and that the
    business will have a significantly improved balance sheet, greater
    operating flexibility and a swift path to profitability."

    The Company expects that shares of its common stock will have no value
    as a result of the Chapter 11 filing.

    The filings were made today in the federal courts in Wilmington,
    Delaware.
