My phone switches itself off by itself.
It always happens when in the middle of a conversation.
Can a softwareupgrade cure this, or would another
battery be better. I just bought an unoriginal battery, since I
got the phone without batt.

It could be the battery or it could be the phone as the 8210 were very well
known for hassle. Also do you know the history of the phone? ie how well was
it kept? has it been dropped? or better still has it had water damage?
