What if his number somehow got ported to T-Mobile? That would explain
why incoming callers get a T-Mobile voice system, wouldn't it?
If Sprint still thinks they have the number, they would not shut off
service on his phone, so he'd still be able to make outgoing calls and
send text messages, wouldn't he?
(That would not explain why incoming text messages, work, though...)

I think you really have to look at it on a case-by-case basis. Obviously,
the carrier will write the contract to be favorable to them, not you. In your
case, I think you might have been able to successfully fight the ETF. In other
cases, maybe not.

I lost a good part of my needed coverage after the Sprint/Nextel deal
in summer/fall of '05. They let me out of the contract without an ETF.

A question.
If you decide to terminate service with Sprint (assuming you have a good
reason) and they bill you for the ETF, what happens if you refuse to pay the
ETF?
What can Sprint do, other than try to harass you and possibly put a
collection agency on you?

Good question. I apologize for not following-up on my own. Thanks for
reminding me.
Here's what happened:
Sprint gave me a new phone number.
Not my top choice for solutions, but it might be ok, because I figured out
how to get into the t-mobile voice mail thing and I changed the outgoing
message to one that advises callers of the new number. How long that will
last, I dunno.
I guess its ok, but if I had $ tied up in business cards and stationary and
such, I'd be pretty pissed.
Technologically what happened? I have no idea.

Go here
http://www.telcodata.us/telcodata/telco
and type in the first 6 digits of the number to see who it belongs
to. If it is a T-Mobile number then Sprint probably released it
back to T-Mobile, which is what happens to a ported-in number when
the customer leaves without porting it out, even though you were
still using the number.
If it is a Sprint number, however, the previous holder of the number
probably ported it out to T-Mobile but Sprint's systems instead listed
it as free and reassigned it to you.
In either case Sprint probably made a mistake related to number porting
(if it was someone else's mistake you would have got the number back).
This is perfectly consistent with my experience with Sprint's billing
and administrative systems.
