transfer itunes purchases after restore

I recently had to restore my iPhone and it had purchases from iTunes on it that were not backed up to any computer and I was wondering how I could get those back without purchasing them again.

from what I remember, iTunes tells you to backup everything so since they tell you to, they are not required by law to give you those files back if you've lost them. sorry :/
