I broke my phone tonight, and am eligible for an upgrade for AT&T, but when I went to purchase a smart phone (Motorola Backflip), they told me I had to sign up for a minimum $30/month smartphone data plan. I do not use internet on my cell phone, so I have no need for a data plan. I already have the unlimited text package on our family plan that costs $30/month. If I bought the Backflip or any other smartphone, and just put my SIM card in the phone, would I be able to get around the data plan requirement? Or is there any other way to be able to get a smart phone without paying the extra $30/month?

Any smartphone REQUIRES the $30 data plan. The only way around it is to buy an unlocked GMS phone from another provider. The phones from another provider are not in AT&T's database, so it is assumed that they will not know that it is a smartphone. There is no guarantee that sometime down the line, AT&T could get the phones info from the manufacturer and then add the data plan then.
