My family plan 2-year contract with AT&T is over, and I can upgrade all of my phones now. I will be getting smart phones from one of the 3rd party cell phone website (such as wirefly,letstalk, amazon), so I will be required to get (200mb/2gb) data plan.

My questions:
1) Can I get a new free smartphone from one of those above website and gift it away, and put my Sim back into the old (current) phone? (is there any charge for not keeping my new phone?)
2) If I cancel the smart-phone data plan after 6 months, will I be charged any fee?
3) Alternatively, If i buy smart phone directly from AT&T with contract extension, can I cancel the data plan right away after getting the phone and put sim back into my old phone or do I have to wait 6 months (like 3rd party sellers) to cancel the data plan?

I only want to cancel the data plan on smartphones, I will still be keeping voice plan.
