Could be. I've had a look at that djfrayne guy's feedback and he's got a lot
of negs. Since his nominated PayPal account isn't in his name, that's a good
indication he's running a scam of some sort which a lot of people are taking
as legit. Problem is he's got a lot of positives too so he much be just on
the edge of gray-marketting so most of the stuff he sells is good but he's
passing off a bunch of it as good when it's not. The biggest problems I see
is the guy wants to sell things that don't match the description in the
listings, and that ludicrous cost for Express Post shipping - any bet that's
used to buy in a phone from Hong Kong or some other suspect cellphone
market.

Time will tell I guess.

True. I've had experiences like that too when I've bid on some car parts,
etc. and not realised how much is going to be asked for shipping without
checking first that the seller only ships using Fedex, etc. It's a trap for
new players in the Ebaying arena.

Actually if the seller specifies Express Post, the seller is obligated to
supply the tracking number when requested. But you're right that the seller
doesn't have to provide it by default, but when something doesn't arrive in
a couple of days after payment as the seller has asked you to to pay for a
domestic shipping service called Express Post, that means Express Post as
offered by Australia Post which is a trackable service.

I wonder what Ebay's legal people think about that? Winning a listing on
Ebay is a legally-binding contract of sale, so you are bound to whatever
terms the seller sets and if you don't agree, you don't bid. But if you do
bid, you agree by inference to all the terms set by the seller. Of course
that doesn't mean you can't nicely ask about things after the sale such as
different shipping methods, but if the seller won't budge, you don't really
have a case if you willingly bid and won the listing.

I don't see Australia Post offering a web-based tracking service for regular
postal articles. And they fit in the 'all shippers' category. 8-)

Actually that's not true because the tracking label forms part of the
Express Post delivery guarantee which Australia Post offers to the seller
when opting to use that service. So the receiver needs that number in order
to prove the delivery time when the seller goes to make a claim against the
delivery guarantee. If a package arrives with the tracking label missing
then a claim can't be made.

Yes, but a seller must provide any tracking number to the buyer on request
as part of the contract of sale. At least through Ebay. I don't know if any
fair trading laws actually specifically say that though, but just because
the law might not ***** it out doesn't mean Ebay's rules don't apply.

Its more complicated than that. Legally you have consumer
rights that apply regardless of what 'terms' the seller might set.

Wrong again. You cant contract away your basic consumer rights.

Thanks for that completely superfluous proof that you dont
actualy have a clue about even the most basic consumer law.

There's a difference between the TYPE of shipping that
will be used and grossly overcharging what it costs the
seller to ship using a particular shipping method.

You can certainly make a profit on the shipping, but if you are
grossly overcharging above what the shipping actually costs
you, you have to make it clear in advance what you will charge.

No it isnt, there is more than one form of that.
