My daughter lived in Victoria. Last june she had to renew her Bell Cel phone contract. As her company had aproached her about possibly being transferred to Manitoba, she specificaly asked the Bell sales rep if they had coverage in Manitoba. The reply was that yes, they did have coverage in Manitoba. She just moved here to Manitoba last week and finds that Bell does not have any cell coverage in Manitoba. She called Bell and they affirmed that they do not have coverage in Manitoba. She requested that they cancel her contract as they do not provide service here. She was told that it was not their fault that she had moved out of the coverage area and she is liable for the whole three year contract, even 'though they do not provide service.
Anybody else had a problem like this? Anyone have a solution?

Yep, but you already ****ed up. What she should've done was notify them 2 weeks before her move. Say she's moving to an area where bell does not provide coverage. Then bring up the fact that your current service provider (bell) MUST provide you with coverage, as it is part of your contract.

Since Bell cannot due this, you are being forced to go to another service provider. Therefore, there should be no cancellation fee, and you are not required to pay for the contract. The person on the phone will probably check this information with higher management, and they will have to confirm that there is no coverage. You'll probably have to argue a bit, but don't be rude or swear, just argue reasonably.

Also bring up the fact that a bell employee stated that there is coverage, and there isn't. They keep a record of recorded conversations (they cannot go back and listen to them) but don't let on that you know this. Tell them to go back and listen to the recorded conversation etc. Don't give up.

I would call and ask nicely (as opposed to screaming like many people are want to do) what can be done and if they say nothing, then ask for a cancellation.

If they won't then tell them you will file a complaint with the Commissioner for Complaints for the Telecommunications sector.

There is a clause that if you moved to an area not serviced by Bell, but serviced by another member of the Bell Wireless Alliance you could get service with them and the Early Termination Fee was waived. They are very clear that they don't guarantee service even in their service area. I would say that from a contract standpoint they can say that you are SOL, however as Hugh suggested give them call and discuss the situation calmly. If you can't get help either fixing the service or being moved back to a CDMA device until the issue is fixed call the Executive Office of the Customer Service VP, the number is in the first several pages of the Bell telephone directory __________________
