has anyone gotten out of a cingular contract without paying the penalty fees, if so how?

Unless you are still w/in the trial period, or Cingular comitted a breach, you signed the contract, you are legally bound to it. Consider it tuition --Life 101.

if you can manage to make 51% of your calls while roaming, then you'll be "forced" out of your contract!

You can get someone to take over the contract for you. Do you know anyone that wants cingular? They can always change the plan to something that fits their needs. If you can't ditch it AND cingular will allow you to change plans without extending your contract, switch it to the cheapest possible plan and stick it out.

how much is left on your contract? you might be better off paying the ETF.
