    I am looking to buy a phone off of ebay and if it has been used before, that means it is unlocked and just needs a sim card that works, am i correct?

    Just because it has been used does not mean it is unlocked. It could still be locked to a certain carrier. If you buy a GSM phone and want it unlocked, just make sure you search for "unlocked". If you dont care if it is unlocked or not, make sure the one you get is locked to Cingular.
