Is that the OEM battery that came with it or an after market battery?

If it's in warranty get the battery replaced. Otherwise you'll have
to buy a new one. (You usually see that problem with aftermarket
    batteries.)

I have used another Motorola battery from another Motorola cell phone and
get the same message. I can take the battery out and put it in another cell
phone it works fine w/o the "invalid battery"

so I would believe it is the phone, CS wants to send me a refurbished phone,
the phone is < 30 days old

Unfortunately, you're probably not going to have much luck convincing
t-mobile to send you a new phone rather than a refurbished one (even though
I totally agree with you, < 30 days should get a new one). I've actually
heard once or twice of people thinking they had convinced t-mobile to send
them a new one.....only to receive a refurbished one anyway!

At this point your best bet is to send it to motorola to have it fixed under
warranty. I dealt with them once in the past (had the top flip on my v60
replaced, and......something else done, can't recall what right now. I want
to say firmware update, but I don't think that was it). They were very
quick, serviced the phone the day they got it, and shipped it back fed-ex
    overnight.

Did you swap chargers too, to eliminate that possibility?

Even if it dies the same day you bought it that's what they'll offer
    you.

Then your choices are CS or Motorola. It sounds as if the phone is
the only thing you haven't eliminated.
