    Yes Folks ! ! !

    I requested my number to be ported from AT&T Wireless to Sprint on Nov.24
    and it FINALLY happened today . . .

    I gotta LAFF . . . They called me to advise me that I may be required to pay
    up to $200.00 in EARLY TERMINATION fees . . .

    Was your contract up?

    If not, they can charge you, and report you to the credit bureaus and/or
    sue if you don't pay, and they will be perfectly within their legal rights
    to do so.

    Your only way out might be if the service was completely unusable - and
    even then, they don't guarantee service everywhere, but if your service was
    OK and subsequently went to hell, you have a good argument for not paying
    the ETF. Do be aware that if you go that route you will most likely end up
    in court.

    Steven I think he was laffing because it took 30 days for him to get his
    number successfully ported and they called to advise him of the term fee.
    I don't think he's disputing the charge from what I gather.

    Well Steven,

    The way I understand it is that AT&T Wireless sold GSM service to their TDMA
    subscribers and anyone else for that matter at cheaper rates with a free
    phone, KNOWING FULLY WELL that the service would be UNSATISFACTORY as their
    equipment here in the US was NOT totally compatible with GSM due to their
    existing antennas are NOT tunable to GSM's higher frequency as well as other
    equipment compatibility issues. My issues were way too many dropped calls,
    and most everyone I would speak with would tell me to call them back when I
    could get to a REAL PHONE, as they said I was breaking up so bad that they
    couldn't understand me and also that it sounded like I had my head in a
    toilet bowl. The echo was so bad at times that I would tell the other party
    that I would call them back on a land line phone. I had to buy a Calling
    Card just for this purpose. We're talking about Los Angeles metro area ! ! !

    One person in a NG explained that AT&T Wireless committed a fraud, as they
    prematurely sold GSM service to generate revenue to upgrade their system
    using their SUBSCRIBER'S money rather than use their profits or borrow
    capital to perform the necessary upgrades in a TIMELY manner. They knew in
    August of 2002 when they started offering GSM that it would be 2 1/2 years
    before they would have their GSM network FULLY OPERATIONAL to provide their
    subscribers with adequate service, which they even admit. Since August 2002,
    AT&T Wireless has given me 5 phones; telling me that they would solve my
    problem. They even gave me a Siemens S46 Multiband phone, which they swore
    up & down would remedy the problem, which of course didn't . . .

    It was also explained to me that they (AT&T Wireless) FAILED to FULFILL the
    terms of my contract as they FAILED to offer me (and MANY if not ALL GSM
    subscribers) USEABLE GSM SERVICE in the US coverage area. All anyone has to
    do if their issue with AT&T Wireless ever goes to court, is to take their
    GSM phone with them and let the JUDGE make a call on it ! ! !

    I was told that I will get forms in my final bill along with a EARLY
    TERMINATION CHARGE to submit to the FCC and PUC to dispute any Early
    Termination Charges.

    By the way, AT&T Wireless is having several Class Action Lawsuits filed
    against them for this reason ! ! !

    I'm now with Sprint and am TOTALLY satisfied with their area coverage &
    VOICE QUALITY . . . It WORKS when I NEED IT ! ! !

    What's interesting is that when I am roaming on ATTWS GSM on my
    Cingular 6340i Nation (GAIT) Plan, the quality is excellent. No
    problems at all. I don't know what they were doing with their own
    subscribers to cause all these problems. Also, their antennas did not
    have to be 'tuned' for GSM as they were using the same frequencies.
    They just had to add some new equipment inside the shack.
