    I posted this on sprintusers.com but was hoping for some insight from
    some of the Sprint guys I don't see on there...sorry for the double
    post for those of you that read both boards.

    So I got suckered into a Samsung A460 a while back (tiny, cool looking,
    and Best Buy paid me $95 to get it). Everything's great-until it starts
    dropping calls like crazy (in areas where my buddies with a 4900 and a
    6400 get service). First Sprint store rep I talked to said it tested
    out fine-nothing she can do. Went to Best Buy for kicks, talked to the
    Sprint rep there-she says the phone's crap and I need a different one.
    She suggests calling CS and threatening to cancel, says I'll get $100
    towards a new phone. Tried this twice, no deal. Went to a different PCS
    store, phone tests fine. Guy suggests an 8100 with $25 off since I've
    only been with Sprint a couple months. I suggest that I could cancel my
    service and sign up with someone else. He brings out the manager, who
    gets precise locational info from me and says that the engineers will
    check it out and call within the next couple days. His suggestion is
    waiting on that and if they find that their service should be fine in
    my area, he'll get me a 4900 or 6400.
    I'm just wondering if he was b.s.-ing me or if this is truly something
    Sprint checks out? Also, does anyone have any suggestions for other
    means of getting a new phone-I've tried everything I've run across in
    this forums.

    CLIFFS NOTES: I'm getting the runaround on switching out my A460-does
    Sprint have engineers actually checking service areas out? Is there a
    better way to get a phone upgrade?

    The short answer is, yes, we have techs that drive out to areas to
    confirm coverage. When the network operations people tell them to do
    so.

    That said, though, I think the manager handed you some rose-colored
    glasses and said they were binoculars.

    One report might or might not get a tech sent out. There's a lot of
    detail I'd look at in awarding a phone credit someone, stuff that
    shouldn't be discussed on a newsgroup. Although I think you've been
    lied to a bit, I think, in general, you've got the straight story.

    This sounds alot like my situation. They suggested I buy a new phone after
    running all the tests, updates, etc. Truth be told, however, their network
    shrank due to the CDMA network being overloaded. I even tried the new
    phones and that didn't work either. They transferred me to a tech services
    guy who asked me detailed questions about the outage area, which I gave to
    them. But nothing was done to correct the problem. All they would tell me
    was that I was receiving service over and over.

    I would bet that if your phone seams to have suddenly started to drop calls
    after working before for a period of time, and the phone checked out ok at
    the store, it's a network problem that they're not likely to fix unless a
    bunch of people start calling in to complain about.

    Prediction/Suggestion:
    Politely ask them to waive the $150 EFT and let you out of your contract so
    you can move on to a service that works. When that fails, as it likely
    will, write a letter to the BBB, or see if someone here will post the
    Executive Services phone number.

    The trick is not to just settle for what they offer you.
    There is a common law principle of "Fitness for purpose",
    which means they sell you a cell phone, and you can't use it, you're
    entitled to your money back.

    So, you don't ask, You tell them! They need to refund your money,
    and if they refuse you write a letter to your State Attorney general,
    with a certfied copy to SprintPCS Corporate Headquarters.

    Thanks for the info guys...I almost wish I hadn't gotten the phone for
    free from BB at this point-I think it'd give me a bit of leverage. At
    this point I know I can get coverage in this area based on my buddies
    with different phones, but they just don't seem to be agreeing. I'm
    going to call the guy tomorrow and see why nothing's been done.

    from Indiana and can't help me up here. Wondering why the guy at the
    store said he'd take care of it. Looks like cancellation time.

    Don't pay the EFT. Write a letter to the BBB and the state attorney generals
    of Kansas and your state. Even if they tell you that they'll waive the EFT,
    they're probably just saying that to get you off the phone.
