retrieve text/pictures

At AT & T, can you retrieve text messages and pictures for the last 10 months with a court order? If so, what is the process? Thanks.

From what I can tell it doesn't look good. I spoke to somone at their 3rd party Court Order Compliance Center who said they do not store ANY text message content on their servers. All they have is to/from date/time info/.

That being said, I know att has coughed up data for court orders. Which I find pretty peculiar if they don't store it somewhere.

I am in exactly the same boat. Obtaining that detail from att will determine whether my husband will spend up to 2 years in prison, or have his case dismissed. The text detail we need is from this feb/mar, not as far back as your though. Good luck to both of us, we need it.

If the messages were stored on the sim card, there is a chance to recover deleted sms. If it ws store on the phone itself it becomes much more difficult, usually impossible. From what I have learned anyway.

Thanks for the information. We have gotten several different answers from AT & T. Several people have told us --they are available if you have the court order and talk to the right people. We just haven't found the right people yet.

We received many answers. Basically the main customer service reps have told us that we can get them with a court order, then they referred us to the court order compliance center. The person there says the do not archive message content.

Our court order was received by at&t, and we are praying for them to cough up these messages. Initial inquiries from our attorney indiacate that at&t will comply with the court order to the best of their ability, but cannot be responsible for content that they simply do not have.

I have not found one single instance where a regular person has received text message content from at&t with or without a court order. The only promising thing I have found is they seemed to have provided them when the judge in the Kobe Bryant case ordered them to 4 months after the alleged victim sent the texts.

I'll let you know how it turns out. Our attorney presented the billing detail showing the times/dates of the text messages to the prosecutor today at his pretrial hearing. The charges were dismissed, but will likely get picked up by the grand jury. We really need that message content!

My heart goes to you both, I work for At&t and I get those requests a lot, things are so tight with FCC regulations we are very limited in what we can say. I can tell you for sure from a customer service stand point we cannot see content at all, just dates and times...cause I've had people beg me on the phone for it. I don't know honestly what it takes to get that information because I've rarely seen anyone get it. But legally, we do have to store that information, its just that no one seems to know how to obtain it.

As far as where it is, our systems that house your voicemails, texts, etc are based on your location, its easy for us to see which HLR houses your info depending on where you live. If you're in Orlando there is one or two servers that would have it, but combing through it all to get it, I have no idea how that all works. Our technical support can narrow down the tower you were on when something was send/when a call was made if it was within about the last 30 days. But I know that doesn't help you in getting content.

My best advice would be to not only have your attorney subpoena the records but law enforcement too, hopefully the double hit will get someone who has access moving on it.

Something else we have in the Southeast part of the US is an intensive care group, specifically based at my call center. They specialize in doing the impossible and figuring out what no one else seems to be able to do. If a representative you ask doesn't know about our ICU group ask them if their manager does. If you file a case with them they get on it right away and see what they can do. If you've both already gone through the right department/compliance center and have gotten nothing it cannot hurt to try them, worst they can say is they can't help.
