Hi all
I work with a law firm thats filed a lawsuit against Sprint claiming the company charged customers substantial late fee penalties that violate California consumer rights laws.
The suit claims that Sprint has wrongfully collected millions of dollars by charging customers late fees of five percent, which is more than the damages actually caused by the customer paying late.

Well I may do that. I pretty much have paid late three times in the past year. Is it possible I may have been taken advantage of. I live in NC

Pretty hard to fight something in the terms and conditions, when you don't pay ontime, you're in breach of contract... 5% is well within the limits of Sprint covering your delinquent bill against its own creditors (you know, it does cost money to actually operate a network), especially if you consider the finance rep that has to spend 10 minutes to setup your payment delay request because you can't pay your bill... average call center costs associated with customer service calls in the wireless industry = $5/minute. I'm sure you'll lose that suit, but thanks for playing. p.s research the actual costs of the customer service involved before baulking at a 5% fee. Also, make a partial payment of what you can, that limits the liability of what you will pay. Example: "I can't pay my bill" ok, so make a partial payment.... so you made no payment at all? Of course your cumulative fee is higher... so easy to dismiss this as a weak argument.
