im trying to build a wap site that i can host and upload midi files so

What sort of help ? If it's about the basics of WAP and WML start here:

As for the ringtone MIDI's, do you have permission of the copyright
holders, or are they public-domain, or your own compositions ?

why do peeps assume the worst, there is a vast amount of music that is
legally public domain, eg Mozart amongst about a million others....

The music itself may be PD, e.g. Mozart, Beethoven., but the MIDI files
themselves often are not.
Someone has taken the time and effort to author a MIDI file. That MIDI
file is protected by copyright unless the author has placed it in the
Public Domain.
