    WASHINGTON-The Federal Communications Commission Monday told telemarketers
    that they must make arrangements to obtain mobile-phone numbers because it
    is illegal to use autodialers to call wireless phones.

    "A telemarketer may make appropriate arrangements with a user to obtain the
    data in a manner that best meets its business needs. Consistent with the
    approach adopted by the commission to rely on the telemarketing industry to
    select solutions that best fit telemarketers' needs, I anticipate that you
    will review the Nov. 21 letter from NeuStar Inc. and the options it presents
    to make available the information required to determine that a wireline
    number has been ported to a wireless service," said K. Dane Snowden, chief
    of the FCC's Consumer and Governmental Affairs Bureau, noting that NeuStar
    had sent a letter that better explains the options available to
    telemarketers to ensure that mobile-phone numbers are not called by
    autodialers.

    Snowden was responding to concerns of the Direct Marketing Association. It
    has been illegal for nearly a decade to place telemarketing calls to mobile
    phones but it became harder for telemarketers to comply once the FCC ruled
    in favor of wireline-to-wireless portability.

    "DMA's current Wireless Suppression Service list will continue to function
    as it does currently for new numbers that are issued to wireless carriers.
    That will not eliminate the problem that arises with intermodal porting,"
    said Jerry Cerasale, DMA senior vice president, in a letter last month to
    the FCC. "It will become a very real problem if marketers are unable to
    identify numbers that are newly ported from wireline to wireless service. In
    short, our members will not know-and they will have no way of knowing-that
    they not place autodialed calls to such numbers."

    offense.

    Of course, this will cost your congressman some big bucks from the
    lost bribes he's been receiving from the spammers.....

    I think if they want to dial a number, they should have to dial it manually.
    That still gives the telemarketers the ability to call you, it just costs
    them more to do it.

    Amen. Blame the morons that make the offense worth committing. Victims of
    any offense that bend over so willingly are food for the infection.
    Telemarketers are like muggers. They do it once, and if it works out they
    do it again, and again, and again . . . I hate telemarketers, but my hatred
    is no motivation for them to stop if people keep forking over the money.

    So the next time someone buys 5 years of "free" magazines for several
    hundred dollars from a telemarketer, be sure to take their phone and use it
    to plug either their inbound or outbound orifice, whichever is more
    convenient at the time.

    BTW, that wasn't Jeff Foxworthy, it was some OTHER redneck that only has one
    joke. Foxworthy has the "you might be a redneck if ___," and some other guy
    has the sign thing.

    Obviously it'll be difficult to tell if someone ported their number or not.
    I say we should let them go ahead and call us on cell numbers that
    previously were land-line numbers. However, if they do the telemarketing
    company should be in my opinion required by law to remit a reimbursement
    check to me for the standard overage rate per minute for all of the airtime
    they use on my cellular bill (whether I went over my minutes or not, since
    they were *my* minutes, not theirs.)

    When the Texas do not call list started I listed my wirless phone
    numbers and wireline numbers, I did the same with the national do not
    call list. So, since the numbers are listed it shouldn't make a
    difference who the number is with or if it is now wireless or wired,
    so why is the DMA saying this is an issue ?

    Because it's illegal to telemarket to cellphones regardless of whether
    or not they are on a DNC list.

    The argument is that they may "innocently" call a "legal" wireline
    number only to find it's now ported to an "illegal" cell phone.

    Personally, not that I love TM calls or anything, I think that's
    simply a concession that wireline-to-wireless porters should be made
    to accept, at least for a reasonable period for TM'ers to make
    whatever upgrades to systems necessary to figure out who's ported to
    whom, particularly since it's not really an inconvenience to place
    yourself on a DNC list.

    Beats me...
    But I registered early on the national "Do not Call List" in
    California and just got a automated telemarketing call selling loans,
    2 days ago...grrrrr!
    Didn't have time to log it and make a complaint.
