Back in 6/2001, a SPCS store fried a Samsung 3500 of mine while
attempting to do a firmware update, and they gave me a refurbished
replacement on the spot. I don't know if the fried handset was less
than one year old at the time or not. I had only had it 2 months, but I
had bought it used from someone else.

I'm sure I've had over a dozen or more firmware updates over the years
    on different handsets without 'fries'.

I've had my phone's firmware updated several times. I must say they're
getting better at it... in the past two years, no cell phone I've had
has been fired through firmware upgrades.

Prior to that, the success rate wasn't so great, and I'd had two phones
fried. In both cases, the tech fessed up to it and immediately replaced
the phone, no questions asked even about the warranty. The second
instance, the tech did manage to extract my phone numbers from the phone
and transfer it to the replacement.

As long as they have the phone in stock, they should replace it without
a problem. If it's an out of production phone, I'm not sure... perhaps
give you equal-value credit towards a new phone?
